Can a self-employed woman work during maternity leave? The answer you want to know
The basic rule from ZSDP-1:
- She may not engage in self-employment from which she receives maternity/parental benefit.
- If the inspection finds that they are working within the scope of this activity, they lose the right to compensation and must return it.
A practical compromise mentioned by SPOT and consulting organizations:
- Vacation time (classical 8:00 a.m.–4:00 p.m.) is intended exclusively for child care,
- In her free time, an entrepreneur can work part-time (e.g., a copyright/enterprise contract), but this must not be work within the same activity for which she receives compensation - it is really a good idea to consult an accountant or lawyer here, because the practice is sensitive.
